The Pubs Code has been in place for 4 years now…
In the second part of our five-part series, we establish that the Code holds little fear for BDMs and the regulated pub companies it is supposed to be holding to account and encouraging to behave better.
The code was intended by parliament to be a means of making the market sector fairer for regulated pub company tenants and to level the playing field while removing a number of the poor business practices which led to its introduction.
The choice for a tenant to be able to go for a market rent only option has been avoided at every turn by the regulated pub companies and the PCA has done little to address this as can be seen by the low number of successful MRO agreements reached.
The code is under review at the moment and here at the FBP we will be working to ensure it does work as parliament intended as a means of creating a fair and more balanced pub sector.
